Before the purchase of any item …….

……. it is advisable to familiarise yourself with the following Terms & Conditions.

Distance buying is always difficult, and we aim to provide maximum peace of mind to all our clients, as is legally possible.  Therefore, if you have any questions about any ready made item, please do contact us and we will be more than happy to address any queries you have.

It is important that you are able to make an informed choice regarding any purchase, and the intention is for you to be happy with anything you buy.

Terms & Conditions of Sale – Ready Made Items

All goods remain the property of Melody R S Berry, registered as Berry Emporium & Melody Unchained Jewellery, until full and final balance payment has been received and cleared.

Returns

  • Jewellery

In the unfortunate event that you purchase an item only to find that it doesn’t suit, and that it isn’t for you, then you legally have 14 days from the date of receipt within which to request a return.

Once the item is returned safely, unworn, in original condition within 14 days of the return request being agreed, a full refund for the ticket price of the item will be given.  This excludes any postage and packing costs.

Return Postage is the responsibility of the Customer, and must be via an appropriate, insured & tracked method, covering the value of the item in full.  We cannot be held responsible for items which are lost in transit via any method, and this would need to be claimed from your chosen carrier.

It is very important that returns are agreed and received within this specified period, otherwise the return will not be accepted.

Note: Earrings are exempt from all returns policy under Law due to hygiene reasons, unless faulty.

  • Spinning Wheels, Weaving & Accessories

Any orders received damaged or missing items, must be notified within 3 days of receipt.  If the packaging has been damaged, you must sign as ‘unchecked’ or ‘damaged’ and take a photograph, which we will then request that you email to us so that we can make a claim against the courier or other delivery provider accordingly for insurance purposes.

Terms & Conditions of Commission/Bespoke Jewellery Sale

These are item specifically designed, made to order, and potentially personalised, to the client.  As such, these items require separate terms & conditions to apply.

All goods remain the property of Melody R S Berry, registered as Berry Emporium & Melody Unchained Jewellery, until full and final balance payment has been received and cleared.

All design copyright remains the property of Melody R S Berry (Berry Emporium & Melody Unchained Jewellery), unless otherwise agreed in writing and remunerated accordingly in perpetuity.

An initial fee of €50 is chargeable immediately that design consultation has commenced.

Once the design is supplied and approved, a quotation for the completed costs will be raised for client review.

Commission Orders will only be scheduled to commence on receipt of 75% non refundable deposit to secure raw materials and labour allocation.  At this stage, the €50 initial design fee will be discounted from the final total payment.

Standard Terms for Completion of Commission Orders will be 12 weeks from date of receipt of deposit, unless otherwise agreed, and specified in writing.

All Commission Items will be fully marked to EU Conventions & Laws

Items made and sold within the EU, namely France, will bear the marks of the purity standards accordingly.

Final Balance Payment will be required prior to despatch or personal delivery/collection of goods, according to agreed terms.

Should a client default on completing payment transactions, we reserve the right to hold the item for up to 60 days in case you change your mind, after which the item will be offered for sale in other markets if suitable, or where heavy personalisation is involved, the item will then be melted down to scrap.  The client will have no right to compensation under the terms of default.

Returns on Commission Items

Bespoke, Personalised, Commission items are excluded from the right to refunds, due to the specific and personalised nature of the order.

Guarantees

All items are purchased according to EU & specifically French Law. Any legal issues arising will be dealt with on this basis.

If a stock item is delivered to you damaged, or with a fault, it will be made good free of charge, or fully refunded, provided the item is returned within 14 days of receipt.  This will not affect your statutory rights.  NOTE: This does not apply to Commission Items, and you should revert to the special section for terms applied to this type of order.

Price of Purchase includes product guarantee against fault for 6 months from the date of purchase or, in the case of commission items, the date of supply.  Any repairs required during this time, arising due to fault, will be undertaken free of charge.

This guarantee excludes damage or fault incurred through misuse, or normal wear and tear.

In the event of fault, please contact us to discuss the issue and arrange return of the item, prior to despatch.

Following receipt of the item, we will conduct a detailed assessment of the item, and make a decision regarding the case of fault, or whether it have been damaged due to misuse or standard wear and tear.  All decisions made are final.  Options will then be offered to resolve the matter, for agreement as to best course of action.  Postage for items damaged arising from a fault will receive a refund on the postal costs incurred to return the item.

In the event that the item has succumbed to misuse or wear and tear, or is outside the guarantee period, provided the repairs are feasible, a quotation will be provided indicating the costs for repair.   Only if the repairs required are not complex, then for a six month period in addition to the original guarantee, a reduced rate for repair may be offered at our discretion.  This will not apply to complex repair arising from misuse or wear and tear.  This therefore extends the cover to the client beyond the UK & EU Legal requirements, at our discretion.

Textiles & Lace

It is your own responsibility to take care of handmade yarns, textiles and lace according to the nature of the fragile natural state.  If in doubt, please request specific care and cleaning instructions for your item.  Never immerse in hot water or use a tumble dryer for these items.

The logo’s and business branding are trademarked with the UK Intellectual Property Office and is legally protected under EU Law.  Any unauthorised use or reproduction, or any imagery and materials published on this website or social media accounts, may result in a claim for damages being lodged.

All designs for commissions will remain the copyright of Melody R S Berry & Martin R Berry; Berry Emporium & Melody Unchained Jewellery, accordingly, unless otherwise agreed in writing with receipt of appropriate remuneration for the work involved, as stated above.
